Welcome to Workiees. These Terms and Conditions govern your use of our website and the services provided by our agency. By accessing our website or engaging our services, you agree to be bound by these terms.
1. Introduction
Workiees ("we", "our", or "us") is a premium digital agency specializing in mobile app development, custom web applications, UI/UX design, and related IT services. These terms apply to all clients, visitors, and users of our services.
2. Services Provided
We provide software development and consulting services as outlined in individual project proposals, Statements of Work (SOW), or service agreements. The scope, timelines, and deliverables will be clearly defined in these project-specific documents.
3. Client Responsibilities
To ensure the successful delivery of projects, clients agree to:
- Provide timely feedback, approvals, and necessary materials (text, images, credentials).
- Ensure that any materials provided to Workiees do not infringe on the intellectual property rights of third parties.
- Communicate promptly regarding any changes in project scope or business requirements.
4. Payment Terms
Payment terms will be specified in your individual service agreement. Generally, we require an upfront deposit before work commences, followed by milestone-based payments. All invoices are due within the timeframe stated on the invoice. Workiees reserves the right to suspend services if payments are delayed.
5. Intellectual Property
Upon full and final payment of all invoices related to a project, the intellectual property rights of the custom-developed software or designs will transfer to the client. Workiees retains the right to use the completed project in our portfolio, case studies, and marketing materials unless a specific Non-Disclosure Agreement (NDA) prohibits it.
6. Confidentiality
We respect your privacy and business secrets. Both parties agree to maintain the confidentiality of any proprietary information shared during the course of the project. We are happy to sign a standard NDA upon request.
7. Limitation of Liability
Workiees strives to deliver bug-free, highly secure software. However, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the software we develop, including but not limited to loss of data, loss of revenue, or business interruption.
8. Project Revisions & Scope Creep
Any requests outside the originally agreed-upon scope of work will be subject to additional charges and timeline adjustments. We will always notify you and provide a revised estimate before proceeding with out-of-scope work.
9. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Madhya Pradesh, India.
